FilmPay Terms of Service

Welcome to FilmPay. By purchasing, accessing, or using any FilmPay products, trackers, services, or subscriptions, you agree to the following Terms of Service.
These Terms govern your use of:
- FilmPay Annual Trackers
- FilmPay Pro
- FilmPay Premium
- Any future FilmPay tools, calculators, or digital services
If you do not agree with these Terms, you must not use FilmPay.
1. Nature of the Service
FilmPay is a digital film payroll tracking and estimation system designed to help performers:
- Track work days and pay
- Estimate Union-based compensation
- Identify potential payroll discrepancies
- Organize income for personal and tax purposes
FilmPay is not payroll, not accounting, and not the Union.
All pay ultimately comes from production payroll companies and is governed by Union agreements.
FilmPay provides estimates and tracking assistance only.
2. License and Permitted Use
You must be legally capable of entering a binding agreement to use FilmPay. By purchasing, you confirm you are doing so for lawful professional use.
FilmPay provides access to its Tracker and related systems as a single-user license. Purchase grants a limited, not-transferable, non-exclusive right for one individual to access and use the service for personal professional use only.
Access may not be shared, sub-licensed, transferred, or provided to any other person. Accounts are intended for a single user. FilmPay reserves the right to suspend or revoke access if unauthorized sharing, duplication, or misuse is detected.
3. Products & Access
Annual Tracker Purchases
When you purchase a FilmPay Tracker, you receive access to that calendar year's tracker only.
Access includes:
- Lifetime viewing/editing of that purchased year
- Updates made within that year’s tracker version
Trackers are licensed, not sold.
4. Annual Renewal Enrollment
By purchasing any FilmPay Annual Tracker product, you acknowledge and agree that:
- Your purchase enrolls you in FilmPay’s Annual Renewal Program
- On January 1 following your purchase, FilmPay may create an annual subscription using your saved payment method
- You will be charged the renewal price unless cancelled prior to renewal
This applies to:
- Annual Tracker purchases (Jan–Nov)
- December Bonus purchases
- Pre-Subscription purchases
You may cancel renewal at any time before Jan 1 by contacting support.
5. Cancellation Policy
- Cancelling prevents future renewal charges
- Cancelling does not revoke access to trackers already paid for
- No partial refunds for unused subscription periods after renewal
6. Refund Policy
FilmPay offers a 14-day refund window from the date of purchase for digital products.
After 14 days:
- All sales are final
- No refunds for used trackers or accessed materials
December Bonus purchases are non-refundable after the 14-day period even though access spans two tracker years.
7. Accuracy Disclaimer
FilmPay estimates are based on Union rate structures and typical payroll formulas. However:
- Payroll companies may interpret agreements differently
- Productions may make errors
- Real-world payments may vary
FilmPay does not guarantee exact payroll matches.
Users must verify discrepancies through:
- Their Agent
- Production Accounting
- The applicable Union
8. User Responsibility
You are responsible for:
- Entering accurate dates and hours
- Selecting correct role and day types
- Verifying your pay stubs
- Reporting discrepancies properly
Incorrect data input will result in inaccurate outputs.
9. Pro & Premium Services
FilmPay Pro
Educational and support-based assistance for using the tracker.
FilmPay Premium
Done-for-you support including:
- Hands-on tracker review
- Pay verification assistance
- Identification of potential missed compensation
Premium does not guarantee recovery but helps identify possible claims.
10. Intellectual Property
All trackers, systems, formulas, layouts, and materials are the property of FilmPay.
You may not:
- Copy or resell trackers
- Share access with others
- Reverse engineer formulas
- Distribute any FilmPay materials publicly
11. Limitation of Liability
FilmPay is not liable for:
- Payroll errors
- Lost wages
- Production miscalculations
- Union disputes
- Financial decisions made using tracker estimates
Use FilmPay as a guidance and verification tool only.
12. Modifications
FilmPay may update these Terms at any time. Continued use constitutes acceptance of updates.
13. Governing Law
These Terms are governed under the laws of British Columbia, Canada.
